To A.D.L. BAKER, Surrogate of Fulton County

 

            The Petition of DANIEL B. STEENBURGH of the town of Broadalbin in the county of Fulton, respectfully showeth: That BENJAMIN STEENBURGH late of the town of Mayfield in the county of Fulton, departed this life in the said county on the eleventh day of September in the year 1882 having previously, as your petitioner is informed and believes, duly made and executed his last will and testament; that your petitioner is one of the executors named in the said will; that the said deceased was a citizen of the United States; that he was at or immediately previous to his death an inhabitant of the county of Fulton; and that his said last will relates to both real and personal estate, and the value of said estate does not exceed the sum of seven thousand dollars or thereabouts.

 

            Your Petitioner further shows, that the heirs and next of kin of the said DANIEL B. STEENBURGH (sic) deceased, are MARGARET ANN ELLIS residing at Neenah, Winnebago Co. Wis., HARRIET DEMAREST residing at Girard, Branch Co. Mich., SARAH E. DEMAREST residing at Tekonsha, Branch Co. Mich., BENJAMIN J. STEENBURGH and ANDREW J. STEENBURGH residing at Mayfield, Fulton Co. NY, and your petitioner, who are children of said deceased --WILLIAM J. GULICK, ANDREW J. GULICK,and JOHN GULICK residing at Gloversville, NY, MARY ELIZA FURGUSON residing at Mayfield, NY, and SARAH THURSTON residing at Johnstown, NY, children of CATHERINE GULICK a deceased daughter of said deceased -- CURTIS STEENBURGH residing at Gloversville, NY a son of JOHN STEENBURGH a deceased son of said deceased, CHARLES BENNETT residing at Gloversville, NY a son of MARTHA J. BENNETT a deceased daughter of said deceased.

 

            Your Petitioner further shows, that he is informed and believes, that the Surrogate of the county of Fulton has jurisdiction to take the proof of the said last will and testament, and over the executors thereof, and the power of granting letters testamentary thereof, with all powers incidental thereto, and that he is desirous that such proofs should be taken and such letters granted, and that such further or other proceedings in the premises should be had, as may be legal and proper. You (sic) petitioner therefore prays, that a citation may issue out of, and under the seal of this court, to be directed to the proper persons, pursuant to the statute in such case made and provided, requiring them, and each of them, at such time and place as shall be in the said citation mentioned, to appear and attend the probate of the said last will and testament. And your petitioner will ever pray, &c.

            On this 18th day of September in the year one thousand eight hundred and eighty two personally appeared before me, DANIEL B. STEENBURGH the petitioner named in the foregoing petition, who being by me duly sworn, did depose and say that he had heard read (sic) the foregoing petition by him (heirs?) subscribed, and knew the contents thereof, and that the same was true of his own knowledge, excepting as to those matters therein stated to be alleged on his information and belief, and as to those matters he believed it to be true.
