This probate record was donated by Lee Garlock who currently lives in Virginia and writes ~

"Here is some information, one is the Will of Simeon Christie Sen.  who also settled in the Mayfield area by the 1790s (if not before) and the Christie Cemetery in Mayfield began as his family cemetery.   Both Simeon and his wife are buried there along with numerous descendants and others....Their are many CHRISTIE families in Montgomery/Fulton Co NY.  It appears that some immigrated before the revolutionary war and some came perhaps as late as the early 1800s.  From the early tombstone's in Johnstown's Revolutionary Cemetery it is clear that a number of these early immigrants were from Perthshire in Scotland.  This is no doubt why one of the towns in Fulton Co. is called Perth.  The known   lineage starts with Simeon Christie and wife Catharine Dennie.  Simeon was the owner of the Christie farm in Mayfield, New York."  See more information about this family at the bottom of the page.

Record of the Will & Proof of the Real Estate of Simeon Christie, deceased.

In the name of God Amen, I Simeon Christie of Mayfield in the County of Montgomery and State of New York, being sensible that it is appointed to all men once to die, and being by the death of others my advanced age and increasingly infirmities admonished to prepare for my latter and though at present sound in mind and memory through divine goodness and mercy, yet not knowing but death may come suddenly do this twenty ninth day of June Anno que Dominie one thousand and eight hundred and twenty six, set my house in order, and make and publish this my last will and testament in the manner following (viz:) principally and first I commit my soul to Almighty God who gave it me and my body to the earth from whence it came to be intered with a decent Christian burial at the discretion of my Friends in hope of a joyful and glorious resurrection to the mansion of eternal life through the merits of Jesus Christ my dear redeemer, and as for such worldly goods and estate as it hath pleased God to bless me with I dispose of in the following manner.  Imprimis my will is that all my just debts funeral charges and cost of settling my estate shall be paid paid out of my personal estate and if not sufficient to pay the same then I do order and direct my three sons viz. Truman, John B. & Simeon and the heirs of Jacob Christie to pay the same each one fourth part. 

Item, I give and bequeath unto my three sons Truman, John B. and Simeon my free hold estate as they now have in possession except where the old barn and shed which my son John B. is to improve so long as they may stand then the land on which they now stand shall belong to my son Simeon. 

Item.  I give and bequeath to my grandson Simeon fourt acres of land off the south end of lot number thirteen Clauses patent when arrives to the age of twenty one years by paying one hundred dollars to my executor. 

Item, I give and bequeath to my Grandson William fourty acres of land in said lot number thirteen next and adjoining the said fourty acres given as above to my Grandson Simeon when he shall arrive at the age of twenty one years and my said Grandson William shall pay fifty dollars to my executor.

Item.  I give and bequeath to my grandson George ten acres of land which I bought of John B. Thurston and the eight acres of land which I bought or my son Jacob Christie, deceased, bought of David Knap making in the whole fourty eight acres of land when he shall arrive to the age of twenty one years and shall pay twenty five dollars to my executor.  All the real estate herein before mentioned as given to my sons Truman, John B., and Simeon and to my grandsons Simeon, William, & George is given to them their heirs and assigns forever and my said grandsons Simeon, William, and George shall each respectively have the right and privilege of getting fire wood for their own use or their families from any part of lot number thirteen aforesaid or from the thirty one acres bought of John B. Thurston or the eight acres of land bought of David Knap as aforesaid and my will further is and I do hereby order & direct that in case either of my sons viz. Truman, John B. or Simeon shall died leaving no male issue or not more than one female who shall live to be of age then the one half of the real estate I have herein given to such said sons shall and is hereby given to my grandson Jacob. 

Item.  I give and bequeath unto my daughter Caty, the wife of Peter Wells, fifty dollars to be paid in five years from my decease to be paid by my three sons, Truman, John B. and Simeon and the heirs of Jacob Christie, deceased each paying one fourth part of the said fifty dollars and my will further is that my son John B. shall have one half of the apples growing on the apple trees now standing on the land I have given to my son Simeon for the term of seven years from the date hereof, and I do further order and direct and my will is that my son Simeon shall have the privilege of getting his fire wood from my son John B'sland until the wood on their respective lots shall be equal Simeon to get fire wood where John B does unless they otherwise agree the wood that is down to be first used. 

Item.  I give and bequeath unto my daughter Elizabeth the widow of John Jackson deceased so long as she remains a widow single and unmarried the use and privilege of the north room to live in and the South Chamber to keep her beds and other furniture in the use and privilege of the cellar kitchen to bake, wash,
and do her work in and what apples she may want for her own use, also a room in the woodhouse for wood, and ground to sow a hald a bushel of flax seed and for a garden where she may choose sufficient to raise her sauce and the privileges of passing and sepassing when her necessary associates may call her; and my will further is that she shall leave with either of my sons as she may choose and that she shall have the privilege of pasturing one horse, two cows, ten sheep and of culling fodder for the same on either the lots of land I have heretofore given my sons Truman, John B., Simeon and the heirs of Jacob Christie deceased and that she shall have either of the rooms in the dwelling house, lately occupied by the widow of Jacob Christie deceased, a privilege in the kitchen, weave house, woodhouse, & water when she may choose to get the same that if my daughter Elizabeth should marry again, she shall have things sufficient to keep house and as good and as much as when she married John Jackson deceased, and my will further is that in case my daughter Elizabeth should make no disposition of the estate herself these the obligation she hold against me shall be equally divided between my sons Truman, John B. and Simeon & the heirs of Jacob Christie, deceased, each on fourth part and I do further order that if my son Truman or my son John B. shall neglect or refuse to pay contribute or grant any of the demands or requirements respecting my daughter Elizabeth as above stated then and in such case my son Simeon is required to hire out use or occupy so much of the land I have herefore given my sons Truman  John B. in this my last will and testament as will enable my executor to fulfil the above requirements as to my daughter Elizabeth and my said daughter Elizabeth shall have my side saddle and in case my said daughter Elizabeth should die without a will then her estate except the obligation against me shall be equally divided amongst my grandaughters when they arrive at the age of eighteen years.  My Scots family Bible shall be kept where I now live with my son Simeon and shall be for the use of my heirs each of whom may take one volume when they wish and keep it one month and then return the same free from injury to the place it was taken from.  My family burying ground shall be and remain as such for the use of my heir to contain one half acre of land and to extend no further west than it is situated and well fenced with stone wall at least four feet height.  My son John B shall have the privilege of passing across my son Simeon's land to the highway where we now travel.  What I have heretofore and herein given my daughter Caty, I consider equal to what I have given to my daughter Elizabeth and I do hereby constitute and appoint my son Simeon my executor of this my last will and testament hereby revoking all former wills by me made.   In witness whereof I have hereunto set my hand and seal this twenty ninth day of June in the year of Our Lord one thousand eight hundred twenty six...

In the matter of proving the will of the Real Estate of Simeon Christie late of the county of Montgomery, deceased.
Samuel Gilbert of the town of Mayfield in the County of Montgomery being first duly sworn deposeth and saith that he saw the said Simeon Christie deceased, subscribe the instrument now shown to him this deponent, and which purports to be the last will and testament of the said Simeon Christie leaving date the twenty ninth day of June in the year of Our Lord one thousand eight hundred and twenty six that he heard the said Simeon Christie declare the same to be his last will and testament and that he this deponent did subscribe his name as a witness thereto at the request of the said Simeon Christie and further that at the time thereof the said
Simeon Christie was of sound ....

 

OF NOTE:
Simeon Christie was married to  Catharine (Caty) Dennea (or Denney) (d. 23 June 1823) they are buried at Christie family cemetery.  Cary's Corners, Mayfield, Fulton Co.  NY. Their children's births are recorded in the records of the Dutch Reformed Church in Mayfield.  Simeon Christie and Catharine Dennie listed joining, by confession, the Dutch Reformed Church of Mayfield 4 Oct 1800.  Simeon CHRISTIE signed a will on 29 Jun 1826 in Mayfield, Fulton Co., NY.  the will was proved in 1838 in Fulton Co. NY.  Simeon's tombstone is difficult to read, being badly worn and broken into about 3 pieces.  Catherine's tombstone reads: Memory of Mrs. Catharine wife of Simeon Christie who d____this life June 23(?) _____year of her age....1822...(biblical Inscription) so our father Adams fall and....glows gospel heavenly light, live with comfort with...,and view beyond the dawn.


The Children of Simeon Christie and Catharine Dennie:
i. Elizabeth (b. 17 June 1780) she was married to John JACKSON who died before 1826.
ii. Jacob (b. 15 Aug 1785 {tombstone says 15 Sept 1785}, d. 30 Oct 1822), married Mary ?   He was buried in Christie Cemetery, Cary's Corner, Mayfield NY.  Tombstone inscription: Jacob Christie d. Oct 30, 1823 aged 31 years, 9 months, & 2 days.
iii. Truman (b. 1 Sept 1787, d. 9 August 1849 in Vermont).  Truman was married Theodorica ? (b. ca. 1791)  In the 1845 state census of Fulton Co., town of Mayfield is Truman Christie with 2 males, 1 female, 2 listed as eligible to vote, all 3 born in NY. owned 30 acres. in the past year the family: made 25 yds unfulled flannel/woolens, 7 yds fulled flannel/woolens, grew 0.5 acres peas (quantity 4), 3-1/2 acres of Potatoes (quantity 60), 3 acres of wheat/quantity 28, 2 acres of corn/quantity 3, 3 acres of oats/quantity 70, had 14 cows (3 yearlings and 4 milking), made 550 lbs of butter and 400 lbs of cheese, had 2 horses, 49 sheep 
(14 lambs, 37 fleeces), obtained 98 lbs of wool, and owned 4 hogs.  See Truman Christie's last Will & Testament.

Children of Elizabeth CHRISTIE and John JACKSON:
i. Caty (b. 31 March 1812, bapt. 5 June 1812 Mayfield Reformed Church).

Children of Jacob CHRISTIE and Mary were:
i. Simeon CHRISTIE was born after 1805.
ii. William CHRISTIE was born after 1805.
iii. George Henry CHRISTIE was born in Dec 1813.  He died on 13 May 1818.  He was buried in Christie Cemetery, Cary's Corner, Mayfield NY.  Tombstone reads s/o Jacob & Mary Christie.
iv. George CHRISTIE.
